Who are we and how do we process your personal data?

HorecAssist is a specialised hospitality recruitment company, operating under the brand names Hospitality Jobs, and HorecAssist Recruitment. We are committed to maintaining the privacy of our candidates, clients and website users. The entity HorecAssist SRL acting as your Data Controller will depend on the services we provide to you, as described below.

We aim to provide a safe and secure user experience. We will ensure that the information you provide to us, or that we collect from you, through various channels (including our website, written correspondence (including emails), conversations or meetings with our consultants or through our offices or websites, worldwide), is only used for the purposes set out in this Privacy Policy.

Through this Privacy Policy, we aim to inform you about the different types of personal data we collect, the purposes for which we use that data and how we process it. We also wish to comply with the transparency obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD) as well as applicable national legislation.

Field of application

The protection of your personal data is our priority. This privacy policy explains how we process and protect personal data about :

  • candidates who register with us for positions we manage on behalf of other employers and for positions within the Companies, or through our website, job boards, social media sites or other sources;
  • potential candidates;
  • Potential customers;
  • business contacts at our customers and suppliers; and
  • users of our websites;

Personal data that we collect

Candidates:

When you register with us as a candidate to provide you with job search services, we process your personal data, including but not limited to your name, contact details and CV information.  We are acting as the data controller for the processing of your data for which you have applied.

When you use our website, click on links in emails we send you, open or forward them, or sign up to receive job alerts or other content from us, we also collect personal data from these interactions.

We also obtain personal data about you from third parties, including

  • referees – when you are offered a job;
  • former employers – to confirm dates of employment;
  • educational institutions – to verify your academic qualifications;
  • publicly available sources, such as LinkedIn and social media sites, to enhance the information we hold about you to help us find more suitable jobs for you;
  • clients to whom we have provided your CV and who have engaged with you on a job application or given feedback on your CV.

Potential Candidates:

We collect personal data about you, including your name and contact details, as well as professional biographical information obtained from publicly available sources, such as LinkedIn, CV posting websites and social media websites, so that we can contact you if we think you might be interested in our job search services at a later date. We may also obtain your personal data through another candidate or employer who recommends you as a contact. We will act as your Data Controller in this case.

Potential Clients :

We collect your contact details and data relating to your function or position in order to establish a business relationship with your company. We will act as the Data Controller for your data.

Users of our website or apps:

We collect personal data such as your IP address and other data about your device, which we need to provide you with our online content. We also collect data about your engagement with our website or apps, such as the pages you view. If you contact us, we will also collect information about your application. We use cookies and similar technologies to collect much of this information and our cookie policy tells you more about this. We act as the Data Controller.

Clients:

We collect personal data such as your name, title and contact details. We also process personal data relating to communications we have had with you, including whether you have opened or forwarded emails, newsletters or other content we have sent to you. We also process feedback you provide on our candidates. We will act as the Data Controller.

If you provide us with information about a candidate (for example, if you confirm that a candidate has worked with you or if you provide a reference), we will obtain your contact details from the candidate and keep a record of the personal data you provide about that candidate.

We process personal data about you from public sources such as LinkedIn and social networking sites or because you have been a delegate to one of our events or to an event where the event organiser is authorised to provide us with delegate details.

Suppliers:

We will usually collect your name and contact details as the business contact for your organisation. We will act as the Data Controller in this case will be the contracting entity in the contract we enter into with you or the company you represent.

Providing your personal data

In some cases, it will be necessary to provide us with personal data. If you do not provide us with the personal data we request, we may not be able to provide our services to you.

How we use your personal data

Candidates:

We use your personal data to :

  • provide you with job search services
  • communicate with you;
  • allow you to upload your CV and apply for jobs;
  • personalise your experience by creating a candidate profile;
  • enable us to ensure equality and diversity;
  • provide you with interview and salary advice; and
  • send you marketing messages to inform you of job opportunities, industry reports and information, events, promotions and competitions, and other content, in accordance with your marketing choices.
  • We also serve relevant, targeted banner ads on our website and within your social networks to introduce you and people like you to jobs and content that we think may be of interest to you. We target these advertisements based on your previous interactions with our website, your emails and your engagements with our consultants. Your interaction with our advertisements may be used to measure the effectiveness of our advertising campaigns and to improve our marketing strategy. This processing is done through the use of cookies and only if you have given your prior consent.

Potential Candidates and Clients:

We use your personal data to :

  • determine whether you may be interested in our services and how we can help you;
  • contact you and find out if you are interested in our services.

Users of our website or apps:

We may use your personal data to:

  • improve and personalise your experience when using our website or applications; and
  • personalise the advertising you receive from us.

Clients:

We may use your personal data to

  • to provide you with recruitment services;
  • to communicate with you;
  • to obtain your feedback on our services through customer satisfaction surveys, in order to improve our services and develop new ones;
  • to maintain our business relationship with you;
  • to respond to your enquiries when you contact us;
  • to fulfil contractual obligations to you;
  • to establish, exercise or defend legal claims; and
  • for marketing purposes.

Suppliers:

We use your personal data to

  • to communicate with you;
  • to maintain our business relationship with you;
  • to respond to your enquiries when you contact us;
  • to fulfil contractual obligations to you;
  • to establish, exercise or defend legal claims; and
  • for marketing purposes.

You can unsubscribe from receiving marketing communications from us by using the unsubscribe methods contained in the communications we send you or by contacting us. We have also set up a marketing preference centre where you can view your marketing preferences, make decisions about them and opt out of receiving marketing messages from us at any time.

Legal basis for processing your personal data

Under the GDPR, we rely on the following legal grounds to process your personal data:

(a) Contract performance – to perform our obligations under a contract with you, for example when clients sign up for certain services or candidates agree to our terms. Or in relation to potential clients or candidates, to take steps necessary to enter into a contract with us.

(b) Compliance with a legal obligation – where we need to process your personal data to comply with legal or regulatory obligations.

(c) Our legitimate interests or those of a third party – including

  • responding to your requests and enquiries (the Companies’ legitimate interest in this case is to maintain constant and up-to-date communication with customers and applicants, which is part of any business relationship);
  • to optimise the performance of our website and the user experience;
  • to contact potential clients in order to establish a business relationship with them (Page’s legitimate interest is to maintain a relationship of any kind with the company where the person contacted works)
  • inform you about our services, job opportunities, industry reports, provide advice and notify you of events, promotions or competitions and ;
  • to ensure that our operations are carried out efficiently or to conduct satisfaction surveys about our services.

We have carried out a legitimate interest assessment to confirm that our interests are not overridden by your interests or fundamental rights and freedoms. You can request this assessment using the contact details below.

(d) Consent In certain circumstances, we will seek your consent to process your personal data. For example, if you apply for a job, we will give you the opportunity to sign up for alerts about similar jobs. To the extent that we process your personal data on the basis of your consent, you have the right to withdraw your consent at any time.  Please contact us if you wish to withdraw your consent.

Automated Decision Making and Profiling

We do not make decisions based solely on an automated process – our decisions are always preceded by human intervention.

We perform two types of profiling based on the candidate’s personal data:

  • Candidate Portal by Zoho Recruit is a tool available on our website to allow candidates to upload their CVs, so that we can recommend positions that match the skills.
  • An intelligent search allows us to filter CVs when we receive many applications for the positions we advertise, and to enter relevant keywords such as years of experience or practice area. It then analyses all the uploaded CVs and provides a shorter list of candidates by matching keywords from the candidates’ CVs and ranking the candidates according to their suitability for the role. As previously explained, a recruiter always checks the process. Thus, no automated decisions are made.

With whom we share your personal data

In no case will we share your private data with a third party company without your consent.

Third parties:

If you are an applicant, we share your personal data with clients who have vacancies for jobs that interest you and to which you have applied. The applicable legal basis is the same as described above: the performance of the contract with the clients and candidates or the taking of measures necessary for the conclusion of a contract and the legitimate interest of HorecAssist SRL in providing information to candidates and services to clients.

We also share your personal data and, where necessary and permitted by law, special category data with third party service providers who perform services and functions on our behalf, such as:

  • employment reference checks ;
  • qualification checks; and
  • criminal conviction checks (if necessary);
  • verification of data provided by you from third party sources;
  • hosting personal data for us;
  • professional consultancy services;
  • data analysis services;
  • administering surveys or competitions on our behalf;
  • helping us to communicate with you; and
  • providing research and direct mail or other marketing services.

We contractually require minimum standards of confidentiality and data protection from our third-party service providers.

Other disclosures

In addition, we may disclose your personal data if

  • if we are legally required to do so ;
  • to law enforcement agencies, regulatory authorities or other government officials; and
  • to new owners of the business and their advisors in the event of a reorganisation, merger, sale, joint venture, assignment or other transfer or disposal of all or part of our business.

Ensure the security of your personal data

We have implemented and maintain appropriate technical and organisational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. Only authorised personnel and third party service providers have access to personal data on a need-to-know basis, and such employees and service providers are contractually bound to treat such information as confidential.

How long your personal data will be kept

We will retain your personal data for as long as necessary to fulfil the purpose for which we collected it, which may be an ongoing purpose. For example, if you are a candidate, we will retain your personal data for the duration of our business relationship with you and beyond, as we often accompany candidates on job placements for many years and potentially throughout their careers.

We retain some personal data for longer than others. In determining the appropriate retention period for personal data, we take into account factors such as the purposes for which we process your personal data, including any legal, regulatory, accounting and reporting obligations, the nature and amount of personal data we hold about you, and the potential risk of harm to you from unauthorised use or disclosure of your personal data.

Where we process your personal data for marketing purposes, we will do so until you ask us to stop, and for a short period after that (to enable us to implement your request). We also keep a record of the fact that you have asked us not to send you marketing or to process your data indefinitely, so that we can comply with your request.

Your rights regarding the personal data we hold about you 

European data protection legislation gives you a number of rights. These rights include the right to ask us for a copy of your personal data, to correct, erase or restrict the processing of your personal data; to obtain the personal data you provide to us for a contract or with your consent in a structured, machine-readable format, and to ask us to share (port) that data to another controller.

In addition, you may object to the processing of your personal data in certain circumstances (including where we do not need to process your personal data to fulfil a contractual or other legal requirement, or where we use the data for marketing purposes).

These rights may be limited, for example, if complying with your request reveals personal data about another person, if it infringes the rights of a third party (including our rights) or if you ask us to delete information that we are required by law to retain or have compelling legitimate interests in retaining. We will inform you of any relevant exemptions we rely on when we respond to your request.
